Specific deliverables, timelines, and pricing for each engagement are described in separate service agreements or proposals agreed upon between you and Aptly Marketing.

2. SMS / Text Message Communications

By providing your mobile phone number to Aptly Marketing — whether through a web form, verbal agreement, or any other means — you expressly consent to receive text messages (SMS/MMS) from Aptly Marketing at the number you provide. Consent is not a condition of purchasing any goods or services. You must be 18 years of age or older to use this SMS service.

Types of Messages

- When you opt in, you may receive text messages related to:

- Information about our services, pricing, and offers

- Responses to inquiries you have submitted

- Appointment confirmations, reminders, and follow-ups

Message Frequency

Message frequency varies based on your interactions with us and any active services you subscribe to. You may receive up to 10 messages per month, though frequency may be higher or lower depending on your activity and requests.

Our text messaging program is supported by most major U.S. carriers. Carrier support is not guaranteed for all mobile carriers. Aptly Marketing and participating carriers are not liable for delayed or undelivered messages.

5. Payment and Billing

Fees for services are described in the applicable service agreement or proposal. Subscription-based services (such as the Complete Marketing System) are billed on a recurring monthly basis. You authorize us to charge your payment method on file for all applicable fees. You may cancel recurring services by providing written notice as described in your service agreement.

6. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific results (e.g., rankings, leads, or revenue) from our marketing services, as results depend on many factors outside our control.

7. Limitation of Liability

To the maximum extent permitted by law, Aptly Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the fees paid by you to us in the three (3) months preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless Aptly Marketing and its officers, employees, and agents from and against any claims, liabilities, damages, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Washington County, Oregon.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
